PZR has developed a report format supported by municipal documentation which provides your staff with a reliable, independently confirmed statement that speaks to the compliance status of your property’s existing use, setbacks, height, density and parking.

Our staff is available to assist in resolving specific zoning issues or problems that arise out of this review process and providing a determination with regard to rebuilding your property in the event of damage or destruction.

By allowing PZR to provide you with this report early in the due diligence process, comfort levels can be reached as to legal conforming and nonconforming issues.

Our Research Includes:

  • The specific zoning designation of the site, as established by the current municipal code.
  • The uses allowed under the zoning designation established by the zoning ordinance and whether the present use of the subject site is legally permitted.
  • The minimum yard or setback requirements and a review of the survey for compliance.
  • The building height requirement, whether by number of stories or actual height above ground level, and a review of the survey for compliance.
  • The bulk or density restrictions of the property, and a determination of compliance.
  • The formula for determining the minimum parking requirement, and a comparison of the required parking count to the actual site count.
  • Special circumstances to be considered would include: legal non-compliance of any of the above factors, the issuance of zoning compliance letters from the municipalities, the existence of variances, council minutes, certificates of occupancy, building inspections and the effect of site plan approval.

Document Acquisition (for sites where no survey to be provided.)

Executive Summary Report (ESR)

The ESR is a brief one or two page report that confirms zoning jurisdiction and designation and provides a conformance determination to use, height, density, setbacks and parking based on current zoning code requirements.

The format specifically provides a “first look” at zoning conditions and identifies areas of possible concern in a very quick and cost-effective manner.

The ESR relies on information obtained from client representatives, local municipal officials, local land surveyors and various internet-based resources of public information. To keep costs and time delays at a minimum, the ESR does not include municipal documents such as zoning letters or copies of documents such as variances, special permits, site plans, and certificates of occupancy or municipal zoning ordinances.

The ESR can be completed much more quickly in this manner, usually within 5 to 7 business days provided a survey or appraisal is available. The fee for each ESR is $300.00.

Fees associated with portfolio transactions of multiple sites are negotiable, when economies of scale allow.

Should the ESR reveal “issues” about the property that require more detail and research, the ESR can be upgraded to a full PZR Report® very easily, with the fee adjusted to that of a typical PZR Report®. This high level of flexibility is very useful in portfolio transactions as a means of containing costs, gaining required levels of zoning compliance comfort and targeting energy and resources on those sites that have “problematic” characteristics.
