2. Are there any outstanding building or zoning violations on file? According to Bonita Williams, Property Standards Department, there are no unresolved violations on file at this time.
According to research, there are no outstanding Building Code violations for this site.
3. Is a Certificate of Occupancy available for the site? The City does not keep copies of the Certificates of Occupancy once they have been issued. However, the Building Department does provide a printout of the date the Certificate of Occupancy was issued. Please find attached the printout providing the date the Certificate
of Occupancy was issued, June 22, 2004, for a change
in ownership. No additional Certificates of Occupancy are required by the City.

VI.         Conclusions

1.  Conformance Status: Legal Conforming to use, setbacks, height, site requirements and density.
Legal Non-conforming to parking. According to Michael Arthaud, Planning Technician, at the time of original approval, the parking requirement for this site was 1.75 spaces for each unit, and as such, is considered legally pre-existing.
2.  Nonconforming Characteristics of the Site Parking is deficient 26 spaces to the current Code.
3. Recommended Action: None
4.  Rebuildability Clause: Per the current Zoning Ordinance Book, Section 2.703 "If a structure occupied by a nonconforming use is destroyed by fire, the elements, or other cause, it may not be rebuilt except to conform to the provisions of this ordinance. In the case of partial destruction of a nonconforming use not exceeding 75% of its reasonable value, reconstruction will be permitted, but the size or function of the nonconforming use cannot be expanded. The above shall apply in all cases except for those specified for UR, RT, and CC districts." (For full text, please see attached)
